User responsibilities

Access to this site is intended for individuals who are legally capable of entering into agreements, or who have the authorization of a parent or legal guardian. Users agree not to use the site for any unlawful purpose, not to distribute malicious content, and not to engage in any behavior that could harm the site or third parties.

Users further agree not to:

Place orders using a payment method they are not authorized to use
Provide false, incomplete, or misleading contact, billing, or shipping information
Use automated systems, bots, or scripts to place orders or scrape site content
Abuse our returns, exchange, or promotional policies, including reselling for commercial purposes without our written consent

Sherman & Son, a brand owned and operated by Captivo Commerce LLC, reserves the right to limit, suspend, or terminate access to an account at its sole discretion in the event of a violation of these terms.

Orders, products, and contact

Product descriptions, images, and prices are provided for informational purposes. While we make every effort to keep this information accurate and up to date, errors may occur and information may be changed without prior notice.

Footwear colors may appear differently depending on your screen settings, and sizing varies between brands and styles. Please consult the size guide provided on each product page. Any measurements shown are approximate.

Customers are responsible for providing accurate contact and shipping information to ensure correct order processing. We ship only to the address provided at checkout and are not responsible for orders delayed, lost, or returned to us as a result of an incorrect or incomplete address supplied by the customer.

Return and refund conditions are governed by our Refund Policy. Shipping timelines and costs are governed by our Shipping Policy.

Order acceptance, pricing, and cancellation

Your order constitutes an offer to purchase. A contract is formed only when we confirm dispatch of your order. Placing an order and receiving an order confirmation email does not guarantee acceptance.

We reserve the right to refuse, limit, or cancel any order, including where:

A product or price has been listed in error
The item is out of stock or unavailable
Order verification or fraud screening indicates a risk of unauthorized or fraudulent use of a payment method
Requested verification is not provided within a reasonable time
Quantities ordered exceed normal individual use, or we reasonably believe the order is placed for unauthorized resale

Where we cancel an order, any payment taken will be refunded in full to the original payment method. Cancellation on these grounds does not entitle you to any further compensation.

Promotional codes and discounts are subject to their stated conditions, are limited to one per order unless stated otherwise, and may be withdrawn at any time. We reserve the right to void discounts and cancel orders where a promotion has been obtained or applied in a manner it was not intended for.

Payment disputes and chargebacks

If you have an issue with your order, please contact us first at info@shermanandson.com. We respond within 1–2 business days and will work with you toward a resolution under our Refund Policy.

Initiating a chargeback for a delivered order that has not been reported to us, or for a claim that our Refund Policy already covers, may be treated as an abuse of these terms. In such cases we may submit tracking records, delivery confirmation, order and device records, and our correspondence with you to the card issuer as evidence, and may decline to accept future orders from that customer.

Intellectual property

All content on this site, including but not limited to text, images, graphics, product photography, and logos, is the property of Captivo Commerce LLC or is used with authorization. Any unauthorized reproduction, distribution, or use is strictly prohibited.

Brand names and trademarks belonging to third parties remain the property of their respective owners and are used for descriptive purposes only.

Third-party services

This site may contain links to third-party services, websites, or platforms. Captivo Commerce LLC has no control over these services and is not responsible for their content, operation, or practices. Access to and use of any third-party services is solely at the user's own risk.

Privacy and personal data

Personal data is collected and processed in accordance with our Privacy Policy and applicable United States data protection laws, including the California Consumer Privacy Act (CCPA/CPRA) where applicable. This includes the use of automated fraud screening and order verification as described in that policy.

User submissions

Any suggestion, idea, feedback, or contribution submitted by a user may be freely used by Captivo Commerce LLC without restriction or compensation. Users represent that their submissions comply with applicable law and do not infringe the rights of any third party.

Where you submit photographs in support of a return, exchange, or claim, you grant us permission to use those images for the purpose of assessing your claim and, where necessary, defending a payment dispute.

Product use and care

Footwear should be used for its intended purpose and cared for in accordance with any care instructions provided. Captivo Commerce LLC is not liable for damage, injury, or loss resulting from improper use, unsuitable conditions, incorrect fit, or improper cleaning or maintenance of a product.

Disclaimer and limitations of liability

This site is provided "as is." Captivo Commerce LLC shall not be liable for any interruptions, errors, damages, or losses resulting from the use of this site.

To the fullest extent permitted by law, our total liability arising out of or relating to any product or order shall not exceed the amount actually paid by you for that order.

Nothing in these terms limits or excludes any rights you may have under applicable federal or state consumer protection laws.

Governing law and modifications

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Captivo Commerce LLC reserves the right to modify these terms at any time. Continued use of the site following the posting of any changes constitutes acceptance of the updated terms.

The terms in effect at the time your order is placed apply to that order.
